1. Acceptance of Terms

Welcome to MoldNation. By accessing or using our website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

2. Description of Services

MoldNation is an online platform that connects homeowners and property managers ("Customers") with mold remediation and related service professionals ("Professionals"). Our Services include:

• A marketplace to find and connect with qualified mold professionals
• Tools for requesting and receiving quotes
• Messaging and communication features
• Reviews and ratings system
• Professional profile management for service providers

Important: MoldNation is a platform that facilitates connections. We do not perform mold remediation services ourselves and are not a party to any agreements between Customers and Professionals.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Not share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Professional Requirements

Professionals using our platform must:

• Hold all required licenses, certifications, and permits for their jurisdiction
• Maintain adequate insurance coverage
• Provide accurate information about their qualifications and services
• Comply with all applicable laws and industry standards
• Respond to customer inquiries in a timely and professional manner
• Honor quotes and commitments made through the platform

MoldNation may verify credentials but does not guarantee the accuracy of Professional information or the quality of their work.

5. Customer Responsibilities

Customers using our platform agree to:

• Provide accurate information about their project and property
• Communicate honestly with Professionals
• Make timely payments as agreed with Professionals
• Leave honest and fair reviews based on actual experiences
• Not use the platform to solicit services outside of MoldNation

6. Fees and Payments

For Customers: Using MoldNation to find and connect with Professionals is free. Any payments for services are made directly to the Professional according to your agreement with them.

For Professionals: Professionals may be charged fees for leads, subscriptions, or other premium features. Fee structures are outlined in separate Professional agreements.

All fees are non-refundable unless otherwise stated.

7. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Post false, misleading, or fraudulent content
• Harass, threaten, or abuse other users
• Interfere with the operation of the Services
• Attempt to gain unauthorized access to our systems
• Use automated means to access the Services without permission
• Circumvent the platform to avoid fees
• Post spam, advertisements, or promotional content

8. Intellectual Property

All content, features, and functionality of the Services, including text, graphics, logos, and software, are owned by MoldNation or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY PROFESSIONALS ON OUR PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOLDNATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY TRANSACTIONS WITH PROFESSIONALS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MoldNation, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.

12. Consent to Communications (TCPA)

By providing your phone number and opting in to receive communications, you expressly consent to receive calls, text messages (including SMS and MMS), and other communications from MoldNation and its service professionals at the number you provide, including through automated dialing systems and prerecorded messages. Consent is not a condition of purchasing any goods or services. Message and data rates may apply.

You may revoke your consent at any time by replying STOP to any text message, updating your notification preferences in your account, or contacting us at support@moldnation.com.

13. DMCA Copyright Policy

We respect the intellectual property rights of others. If you believe content on MoldNation infringes your copyright, please send a written notice to our designated DMCA agent with the following information: (1) a description of the copyrighted work, (2) the URL of the infringing content, (3) your contact information, (4) a statement of good-faith belief that the use is not authorized, and (5) a statement under penalty of perjury that your notice is accurate.

14. Reviews and Testimonials

All reviews and ratings on MoldNation must reflect genuine experiences. In accordance with FTC guidelines (16 CFR Part 465), the following are strictly prohibited:

• Writing or purchasing fake reviews
• Offering compensation in exchange for positive reviews
• Suppressing or deleting legitimate negative reviews
• Using AI-generated or bot-generated reviews
• Reviewing your own business or a competitor's business

Violations may result in immediate account termination and may be reported to the Federal Trade Commission.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Opt-Out: You may opt out of the arbitration agreement by sending written notice to support@moldnation.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of binding arbitration.

16. Business Listing Disputes

MoldNation may display publicly available business information sourced from third-party directories. If your business appears on our platform without your authorization and you would like it removed, you may submit a removal request through our platform or by contacting us at support@moldnation.com.

We will process verified removal requests within 10 business days.
